Details of Judiciary of Kenya Vacancy Positions & How to Apply.

The Judiciary is one of the three State organs established under Chapter 10, Article 159 of the Constitution of Kenya. It establishes the Judiciary as an independent custodian of justice in Kenya. Its primary role is to exercise judicial authority given to it, by the people of Kenya. The institution is mandated to deliver justice in line with the Constitution and other laws. It is expected to resolve disputes in a just manner with a view to protecting the rights and liberties of all, thereby facilitating the attainment of the ideal rule of law.

Terms of Service  

Retirement at the age of seventy (70) years with the option for early retirement after attaining the age of sixty –five (65) years in accordance with Article 167(1) of the Constitution. Remuneration and benefits: Based on guidelines issued by the Salaries and Remuneration Commission of Kenya. Gross Monthly Remuneration Package excluding benefits: (Kshs) Minimum 792,000 to a Maximum of 1,218,535.

Requirements

Constitutional and Statutory Requirements for Appointment:
For appointment to the position of Judge of the Supreme Court, the applicant must possess the following minimum qualifications set out in Article 166 (2) and (3) of the Constitution, namely:

  1. Hold a law degree from a recognized university, or be an advocate of the High Court of Kenya, or possess an equivalent qualification in a common-law jurisdiction; and
  2. Have at least fifteen (15) years’ experience as a superior court judge; or
    1. Have at least fifteen (15) years’ experience as a distinguished academic, judicial officer, legal practitioner or such experience in other relevant legal field;   or
    2. Have held the qualifications specified in paragraphs 2 (a) and (b) above for a period amounting, in the aggregate, to fifteen (15) years;
    3. Possess the experience required under paragraph 2 (a),(b) and (c) above as applicable, irrespective of whether that experience was gained in Kenya or in another commonwealth common-law jurisdiction; and
  3. Have a high moral character, integrity and impartiality (meet the requirements of Chapter Six of the Constitution on Leadership and Integrity).

In addition, the applicants should demonstrate a high degree of professional competence, communication skills, fairness, good temperament, good judgment, wide breath of both legal and life experience and demonstrable commitment to public and community service.
The appointment shall be made in accordance with Article 166 (1)(b), (2) and (3) of the Constitution 2010 and Section 30, Part V and the First Schedule of the Judicial Service Act, No. 1 of 2011.

Duties and Responsibilities

Functions: 

A Judge of the Supreme Court shall serve in the Supreme Court of Kenya. The function and jurisdiction of the Court is provided for under Article 163 (3) (a),(b), 4, 5 and 6 of the Constitution, namely;

  1. Have exclusive original jurisdiction to hear and determine disputes relating to the elections to the office of President arising under Article 140; and
  2. To hear and determine in its appellate jurisdiction appeals from:
    1. the Court of Appeal; and
    2. any other Court or Tribunal as prescribed by national legislation.
  3. Give an advisory opinion at the request of the national government, any State organ, or any county government with respect to any matter concerning county government.

Method of Application

Interested and qualified persons are requested to make their application by:

  1. Letter of Application,
  2. Detailed and updated curriculum vitae, summarizing the applicant’s bio-data including, background information such as community service, financial discipline, pro bono activity, involvement as a party in litigation and involvement in political activity including financial contribution to political party/parties (if any), criminal record and legal education, legal practice engagement for the last five (5) years,
  3. Names of three (3) professional references and two (2) character references who can verify and comment on the applicant’s past and present employment,
  4. Applicant’s recent coloured passport size photograph,
  5. Five (5) samples of any professional writings, including but not limited to judgments, advocacy submissions in courts, scholarly writings or any legal publications that the applicant has authored,
  6. Declaration of income and liabilities as at the time of making the application, using the prescribed forms. The Declarationof Income, Assets and Liabilities Form JSC 2b can be downloaded from the JSC website – www.jsc.go.ke – Downloads.

Public officers should attach copies of returns of declarations of income, asset and liabilities for the last three declarations. Those in private practice should attach audited accounts and tax returns for the last three (3) years.

  1. Certified copies of testimonials, professional certificates, academic transcripts and certificate of admission to the roll of Advocates.
  2. Completed Application for Employment Form – JSC 2A (for public officers) or JSC 2 (for other applicants) which can be downloaded from the JSC website – www.jsc.go.ke – Downloads.
  3. Applicants are also required to forward one (1) hard copy of the completed Application for Employment Form including copies all attachments cited above to:

Shortlisted candidates will be required to carry the following documents during the interview:
Valid original clearance certificates from the following bodies during the interview:

  1. Kenya Revenue Authority,
  2. Higher Education Loans Board,
  3. Law Society of Kenya,
  4. Directorate of Criminal Investigations,
  5. Advocates Complaints Commission,
  6. Ethics and Anti-Corruption Commission and
  7. A recognized Credit Reference Bureau.

Original testimonials, professional certificates, academic transcripts and certificate of admission to the roll of Advocates. Applicants MUST take note that it is a criminal offence to provide false information and documents in the job application and the same will be verified by relevant bodies.
